Terms of Service

By accessing or using any website, portal, or service operated by Brightpath Ascend Group®, you agree to be bound by these Terms of Service.
If you do not agree to these terms, do not use our services. These terms constitute a legally binding agreement between you and BAG.
Description of Services
Brightpath Ascend Business Solutions® provides business entity structuring, business credit development, and fundability optimization services. Our services include LLC and corporation formation, EIN acquisition, business credibility architecture (411 listings, professional addresses, dedicated phone lines), business credit bureau file establishment (D&B, Experian Business, Equifax Business), trade line and vendor account setup, and funding pathway preparation. BAG is not a law firm, lender, or financial advisor.
Eligibility
You must be at least 18 years of age and a legal resident of the United States to use our services. By using our services, you represent and warrant that you meet these eligibility requirements and have the legal capacity to enter into a binding agreement.
Account Registration and Security
To access certain services, you may be required to create an account on our client portal. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You agree to notify BAG immediately of any unauthorized use of your account. BAG is not liable for any loss arising from your failure to safeguard your account information.
Fees and Payment
BAG charges fees for business structuring and credit development services as outlined in your individual service agreement. Service packages, pricing, and payment schedules will be clearly disclosed before any work begins. Fees are earned as services are performed. Refund eligibility is governed by the terms of your individual service agreement.
Intellectual Property
All content on BAG’s websites and portals — including text, graphics, logos, design elements, software, and documentation — is the property of Brightpath Ascend Group and is protected by applicable intellectual property laws. You may not reproduce, distribute, modify, or create derivative works from any BAG content without prior written consent.
Limitation of Liability
BAG does not guarantee specific outcomes, credit approvals, funding amounts, or business credit scores. Results vary based on individual circumstances, bureau processing, and lender criteria. BAG’s services are provided “as is” and “as available.”
To the maximum extent permitted by law, BAG shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from or related to your use of our services. BAG’s total liability shall not exceed the amount of fees you have paid to BAG in the twelve (12) months preceding the claim.
Dispute Resolution
These Terms shall be governed by and construed in accordance with the laws of the State of New York, without regard to conflict of law principles. Any dispute arising from or relating to these Terms or your use of BAG’s services shall be resolved through binding arbitration in New York County, New York, in accordance with the rules of the American Arbitration Association. You agree to waive any right to a jury trial or to participate in a class action.
Termination
BAG may suspend or terminate your access to our services at any time for violation of these Terms, non-payment, or any other reason at BAG’s sole discretion. You may terminate your engagement with BAG at any time by written notice to corporate@brightpathascendgroup.com. Termination does not relieve you of any obligation to pay fees for services already rendered.
